...but in all honousty, apart from unique speech or other *very* typical samples, one can always say the he or she made the sample/instrument him-/herself. No way anyone can prove anyone that a sawsynth is anyone's property. Drums, synthstabs, and other 'standard' sounds can always be justified by the user of them. Just watch out what lyrics and fx you use, and contact the author of them when in doubt.
