Sample Clearance

Hi all,
I was wondering if anyone knew if there is a certain time limit on samples to use them in a song, without having to go thru sample clearance garbage. I thought I heard that you can use a music piece as long as it's not over 4 bars of the song. I was planning to use a sample from Miracle on 34th Street (1947) and didn't want to have to go thru all the hassle of clearance if I don't have to. Any insight is appreciated. Thanks.

Thanks, I appreciate the help. Yeah things are looking rather bleak for sample-based musicians. Really the sample I have is from a movie. I was hoping because of it only being a 6 second sample, that I might not have to worry about it, but oh well...

well, theoretically you'd need the clearance. But unless you're planning a commercial release, I doubt you'd get any problems if you use a snippet from a movie. I doubt the big corps would start hunting you down, and even in the highly unlikely chance they would find your track and the sample and conclude it's their copyright, you'd probably only get a warning and a request to remove said sample from your track. That is if you DON'T make any money off the track. If you do make money with a track that contains uncleared samples, then you might get bigger problems...

I've heard of several artists that have gotten their breakthru when they demoed tracks that contained copyrighted samples. The labels then either cleared the samples, or if they didn't get the clearance, that sample was removed or replaced with some other sample.

That's why I personally never use recognizable samples. It's not that I have anything against using samples in songs, but because I don't want to have copyright problems (the only song using a copyrighted sample I did is the one I did for the downhillbattle.org 3 notes protest song "compo", for which using the given sample was compulsory). (My song, "Art knows no laws" is available here)

The funniest thing is that - as everybody uses samples nowadays - some people think I use (c)ed samples, even when the samples I use were 100% mine. Exemple : The beginning voices of my track Antares rising (Sunbuster : Antares again...) that many people think is a sample from Arnold Schwartzenegger, whereas in fact it is a sample of me with some (heavy) pitch shifting on it...
