I occassionaly Google for MadTracker. The most remarkable finding to date is this scientific paper by a student on the moral dilemma of sample ripping. I never knew that Plato, Aristotle and Kant would be of use to MadTracker composers Enjoy your reading!

hmm, it was an interesting read... not quite sure what to make of it though, since he put a link to www.madtracker.com, and I only found a virtual host test there
Also, didn't know yannick was German, and that Madtracker is copyrighted in Germany...
But hey, one thing I realized. This guy knows Yannick's face (he had a personal interview with Yannick) Maybe we can get him to take a candid shot of Yannick for the mt user gallery  |

btw, he talks about stealing drumloops, i just had copyright lessons in school, and drumloops aren't copyrighted. you can take all the drums you want. Very nice, so i know some of the things i steal are legal. |

really? what rules apply, and are the rules international..?
Edit: I remember this was a topic in the old forum...As far as I remember US copyright stated that you couldnt use any samples without permisson. |

Well, i'm startin to have doubts now too.
It was like this, you can't take a melody and use it, but drums are not considered melody. So you can take those. But now i'm starting to wonder if it's drumpatterns that you can take, like boem...tak....boemtak, or actual samples. Ooooh i remember something, the talked about, you can take any drums you want, as long as there's no melodic content. So he must have been talking about samples. |

Anyway, unless a drum is very particular, how could one claim one has ripped another's bassdrum for exemple.
The same 909 kit has been used in zillions of trance/dance/house/electro/R&B/whatever tracks, and as far as I know, no one ever got sued about it.
I don't know about drumloops, but I think that simple drum hits (a bassdrum, a snare...) are not copyrighted.
Anyway, feel free to borrow any sample of my songs (notify me if you want to use mine & Caillean's vocals however).

You know, some guys are PAID to find out what the sound of an exploding thermonuclear bomb exactly sounds like, to evaluate what kind of ear damages someone standing near an exploding thermonuclear bomb may suffer...err, even if I am not a scientist, I think it's quite obvious that someone standing nearby an exploding thermonuclear bomb may be just a bit too dead to suffer from ear damages...
That's cool with thermonuclear bombs : It hurts a lot, but no one who ever suffered from it complained about it afterwards
So that MT based study is by far not the most stupid study that has ever been funded...

About ripping drumloops being ok because they're not considered melodic, how do you define melody? I mean, even drums can be used to play a melody, since you can tune drums to various pitches. So if someone uses drums to play for instance the notes c-4, d#4, f-4, g-4, d#4, in loops and someone else ripps it, why would that be any different from someone ripping a piano representation of the same notes? |

Especially if it's Steel Drums... very melodic.
But anyway - melody or not, recording or not - How come it's always drummers that are the exception? So it's ok to rip off a drummer, but not a guitarist? That's predudiced.  |

I dont think that even loops are legal to use. You all know Pauls Boutique by Beastie Boys!?: It is said that that record couldnt have been made today because of the copyright restrictions - it would simply have been to expensive to make (legally ofcourse).
And it does sound odd that drummers should be an execption, doesn`t it?

Well, i just went over my notes it says this:
'Copyright is valid for 70 years after the longest living composer died (we're talking about lyrics and melody and stuff here, not sampling).'
'If you find a composition (sometimes people find, i dunno, verdi's and chopins and stuff) that hasn't been claimed yet you can claim copyright for 25 years.'
'Masterrights (these usually belong to the audio engineer or producer, and are the one's you should pay when sampling) are valid for 50 years.' So, everybody go out and sample elvis presley now. Everything from before 1953 (edit: i mean 1954 ofcourse) is absolutely free.
And here is the one we were talking about. Sadly i have no explanation about this one, but i asked about it to make sure i understood, because i sample drums all the time.
'drums sampling is legal'
Oh yeah, also nice to know: you don't have to claim copyright or anything, you have the copyright when you created something (anything). The thing is, people could take it and say 'no, i came up with this'. So what you need to do if you want to be safe is: 'whatever you want to protect (in our case i'd put the song (original .mt2 for sure, and everything used on it (samples, vst's)), put it in a sealed envelope and send it to yourself (registered! if that's the correct term, in dutch it's "aangetekend"), then put it somewhere safe, and never open it ofcourse.
Well, ok. Hope this helps anybody. Sunbuster or Myztique, one of you studied at SAE too right? Didn't you get copyright lessons? |
